Child Support
Child support is the amount of money the court will order one parent to pay the other parent every month for the support and care of their children. Child support also includes past due obligations owed on behalf of the child. In California, child support is generally made until the child reaches the age of 18, or when the child is able to support him/herself.
Under Federal laws passed in the 1980’s, states are required to establish guidelines to determine child support. In implementing these guidelines, courts are required to adhere to the principles that 1) a parent's first and principal obligation is to support his or her minor children according to the parent's circumstances and station in life; and 2) both parents are mutually responsible for the support of their children.
Child support is determined by numerous factors including the income of the parent and the number of children. These guidelines try to approximate the proportion of parental income that would have been spent for child support had the family not been divorced.
